FX Headway provides its service, subject to the following Terms of Service, which may be updated by the FX Headway or its representatives from time to time via email or internal messaging system. The most current version of the Terms of Service can be reviewed at any time through the use of our website (www.mutualtreaty.com). The Terms of Service govern FX Headway and Affiliate Organizations. You agree to be subject to the following terms of service by opening an FX Headway investment account.

Registration Obligations

In consideration of use of the Service, Client agrees to the best of their abilities to:

• Be at least 18 years old and act as an individual.
• Provide current and complete information about themselves, their organization and its users (such information being the “Registration Data”)
• Maintain and update the Registration Data to keep it current and complete.
• Realize risks involved in investing and do not invest what you cannot afford to lose.

Members Account, Password and Security

Client is responsible for maintaining the confidentiality of the password and account, and is fully responsible for all activities that occur under such password or account. Client agrees to:

• Immediately notify FX Headway or its representatives of any unauthorized use of client’s password or account or any other breach of security.
• Ensure that client logs out from its account at the end of each session. FX Headway and its representatives will not be liable for any loss or damage arising from client’s failure to comply with this Section.

Member Conduct

Client agrees to not use the service for any illegal purpose or in any manner inconsistent with the terms and conditions of service. Client agrees that communication between client and FX Headway personnel is private and is not subject to disclosure.

Special Admonition News

If client receives or requests any news, messages, alerts or other information from the FX Headway website concerning companies, Forex, investments or securities, such information is provided for informational purposes only, and no content included in the service is intended for trading or investing purposes. FX Headway and its representatives, and its licensors shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the service, and shall not be responsible or liable for any trading or investment decisions made based on such information.

Submissions

You acknowledge and agree that any materials, including but not limited to questions, comments, suggestions, ideas, programs, notes, original or creative materials or other information, provided by you in the form of e-mail or other submissions to FX Headway, or postings on this Web site, are non-confidential and shall become the sole property of FX Headway that shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you. The submission of any materials to FX Headway including the posting of materials to any forum or interactive area, irrevocably waives any and all “moral rights” in such materials, including the rights of paternity and integrity.

General Information

The Terms of Service and any Subscription Agreement between client and FX Headway and its representatives constitute the entire agreement between client and FX Headway and its representatives and govern your use of the service, superceding any prior agreements between you and FX Headway and its representatives.

Trademarks

The trademarks, service marks, designs, and logos (collectively, the “Trademarks”) displayed on this Site and/or on e-mails sent to you are the registered and unregistered Trademarks of FX Headway and of FX Headway Trade’s licensors. Your use of the Trademarks displayed on this Site, except as provided in these Terms, is strictly prohibited.

Important Note

You may not post content that:

• is false or intentionally misleading;
• is patently offensive to users of the FX Headway site, such as Content or messages that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
• harasses or advocates harassment of another person;
• involves the transmission of unsolicited mass mailing or “spamming”;
• promotes illegal activities or conduct that is abusive;
• is threatening, obscene, defamatory or libelous;
• is pornographic or sexually explicit in nature;
• seeks or recommends providers of material that exploits people under the age of 18 in a sexual or violent manner.

Legal Limitations

The Customer must understand that laws concerning financial contracts vary throughout the world, and it is solely the Customer’s obligation to make sure and guarantee that he/she fully obeys and fulfils the laws and regulations of the country of residency from which he/she is accessing the Web site and its services. The fact that the Client accesses our website does not actually mean that the services there offered are officially permitted under the regulations and laws of the country of residency or where the Client is accessing them from.

IN REGARDS TO TAX PAYING Without limiting this document, it is solely the obligation and responsibility of the Customer to calculate and pay all the taxes applicable to him/her in the country from which he is accessing the service by us provided. FX Headway has nothing to do with tax paying by the Customer. Forex investment, as well as any other investment business involves high risk and you may lose all of your money.
